Oppose an Increase in Nursing Home & LTC Provider Penalties

Oppose A.5372 (Paulin)/S.6071 (Cleare)

LeadingAge New York opposes A.5372 (Paulin)/S.6071 (Cleare), a comprehensive bill which would raise the maximum penalties for any individual or organization that violates the Public Health Law. While we appreciate the bill’s goals of improving compliance, we believe the negative impact of heavy fines will outweigh the benefits of the legislation for our not-for-profit, mission-driven provider members and the older New Yorkers they serve.

Importantly, the financial impact of raising the maximum penalty for State health law violations would be significant for LTPAC providers because nursing homes, certified home health agencies, and hospice programs are already subject to federal fines as well as State fines. Because most State nursing home requirements duplicate federal requirements, the cost of even minor violations can quickly compound and grow to astronomical levels.

Enter your information below to contact your lawmakers, urging them to reject an increase in penalties for nursing homes and other LTPAC providers. You can also access LeadingAge NY’s memo in opposition here.
