State Issues Updated Resources for Employers to Implement Sexual Harassment Policies

On April 11, 2023, Governor Hochul released resources and updates to New York’s Sexual Harassment Model Policy to assist employers to comply with state laws protecting employees from sexual harassment in the workplace. Under state law, employers must adopt a sexual harassment prevention policy and may use the State’s model policy or adopt their own policy that meets or exceeds the State’s minimum standards.

The updated policy covers a broader scope of topics than the prior policy and includes provisions related to gender diversity, sexual harassment of remote workers via virtual platforms, and bystander intervention and reporting. In addition to the model policy, the State has released online training resources, an interactive training video, a model notice and complaint form, and Frequently Asked Questions (FAQs)
