DOH Posts Guidance Requiring Registration and Reporting by Staffing Agencies

Legislation enacted in the 2023-24 State Budget requires temporary health care services agencies (staffing agencies) and health care technology platforms to register with the Department of Health (DOH). This law went into effect on Aug. 1, 2023.

DOH recently posted guidance implementing registration and reporting requirements for these entities. The guidance is available hereAn overview of the requirement is provided in LeadingAge NY's 2023-24 State Budget summary here on pages 8 and 9.

The deadline for submission of the registration file and appendices for entities subject to this requirement has been extended to Oct. 30, 2023. Any person operating a temporary health care services agency in NYS must submit the registration file, along with Appendices 1-5 and renewal fee, by Oct. 30, 2023. The submission of the quarterly reporting file, as well as Appendices 6-9, will be due by Nov. 30, 2023 and quarterly thereafter.

DOH has compiled questions from the mailbox and briefing, and they are working through the approval process and expect to post a Frequently Asked Questions (FAQ) document soon. The document will be sent to contacts on the listserv and posted on the DOH website.
