New Disclosure Requirement for Nursing Homes

A bill signed into law by Governor Cuomo on Aug. 2, 2021 amends Public Health Law §2803 and is aimed at increasing awareness among both nursing home residents and families as to the availability of compliance information maintained by the Department of Health (DOH). The requirement becomes effective Oct. 1, 2021. Nursing homes are required to provide residents and their families with a separate document, in no less than 12-point font, that includes information on how potential residents and families can find information on the following:

  • how to look up complaints, citations, inspections, enforcement actions, and penalties taken against the facility;
  • the web address for the New York State Nursing Home Profiles website maintained by DOH; and
  • the web address for the Nursing Home Compare website maintained by the U.S. Department of Health and Human Services (HHS), if applicable.

LeadingAge NY has developed a sample template that nursing homes may use to meet the new requirements.
