CMS Proposed Nursing Home Regulations

LeadingAge NY counsel Hinman Straub P.C. has provided a summary of the proposed Centers for Medicare and Medicaid Services (CMS) nursing home regulations. The proposed changes cover a number of regulatory areas, including Resident Rights, Infection Control, Pharmacy Services, Food and Nutrition Services, and Administration. In addition to the proposed changes, certain requirements that were to be implemented in November 2019 have been delayed. The requirements that are being delayed and modified involve the Infection Control Preventionist (IP), specific requirements around the Quality Assurance and Performance Improvement (QAPI) program, and the implementation of the Compliance and Ethics Program.

CMS has asked that any comments on the proposed regulations be submitted by Sept. 16, 2019. Members interested in providing comments should forward their comments to LeadingAge NY by Sept. 9, 2019. LeadingAge NY will gather member comments and submit them directly to CMS.
