Nursing Home Capital Attestations Due Nov. 30th

We remind members that the nursing home 2023 capital rate preview process is nearing its end. On Oct. 20th, the Department of Health (DOH) notified nursing homes that it had posted 2023 Medicaid Capital Preview Rates on the Health Commerce System (HCS). Accompanying the posting was the Dear Administrator Letter (DAL), Attestation Form, and a new Capital Attestation Workbook (click here to download Excel Workbook). Members will recall that this is an annual process that allows nursing homes to review the Department’s capital calculation and offer corrections in hopes that it will minimize the need for formal appeals. All homes, whether offering corrections or agreeing with the State’s calculations, are required to submit an attestation. The attestations and any correction requests are due by Nov. 30th.

The DAL contains a brief description of the information provided in the Capital Attestation Workbook and indicates which forms should be used for which purpose. As was the case last year, providers requesting a correction based on a reporting error or omission will be required to re-file their 2021 Residential Health Care Facility (RHCF) Medicaid Cost Report. For this reason, we urge members to review their capital calculations without delay.

The signed 2023 Capital Preview Rate Attestation Form and, if applicable, the completed attestation request form (along with necessary documentation) must be submitted via email to nfrates@health.ny.gov by close of business Wed., Nov. 30, 2022. The subject line of the email should state “2023 Capital Preview Rate Attestation.”

To access the preview rate sheets, log into the HCS, navigate to the Healthcare Financial Data Gateway Publications, select the collection “NH Rate Sheets 4/2009-Forward,” and choose the package named “2023 Capital Preview Rates.”
