DOH Clarifies MLTC Minimum Wage Report Instructions

The Department of Health (DOH) has clarified the reporting instructions for the Minimum Wage Reconciliation Cost Report (MWRCR) that Managed Long Term Care (MLTC) plans are required to file. When reporting the amount of the incremental increase in Minimum Wage Funds paid to a provider, the incremental amount refers to the total increase for minimum wage added to rates from when the minimum wage law went into effect on Dec. 31, 2016. Specifically for the first quarter of 2018, the incremental is from Dec. 31, 2016, prior to the implementation of minimum wage. Additionally, the expenses reported should not be the total wages built into provider rates, nor should they include any increases paid to providers for reasons other than assisting providers in meeting the minimum wage law that went into effect on Dec. 31, 2016.

Organizations that need to correct the data submitted for the first quarter of 2018 based on this clarification may do so by contacting DOH at mltcrsmw@health.ny.gov with an explanation of the error. DOH will open the plan's 2018 Q1 MWRCR for resubmission. The process must be completed by Oct. 11, 2019.
