New MLTC Policy on CDPAP and PACE

Pursuant to MRT #90, the Department of Health (DOH) implemented the transition of consumers receiving Consumer Directed Personal Assistance Service (CDPAS) into MLTC, Medicaid Advantage Plus (MAP) plans and PACE plans. DOH also directed MLTC plans to offer CDPAS as an option to all new and current members.

At the direction of the Centers for Medicare and Medicaid Services (CMS), DOH is providing clarification on how to use CDPAS in a PACE plan. According to this policy, PACE plans must offer the CDPAS as an option with an explanation of steps that a consumer must agree to follow in order to particpate in the program as a PACE member.

The PACE plan must conduct a Criminal History Background Check on any proposed Personal Assistant (PA). The policy also specifies that the PACE plan is responsible for compliance with Federal regulations ensuring the competency of any individual rendering care to a benficiary. The PA will have to attend a PACE orientation that includes member-specific plan of care compentencies and ongoing supervision, as conducted by the PACE plan.
