DOH Issues SSI COLA DAL for ACFs

The Department of Health (DOH) recently issued the annual Dear Administrator Letter (DAL) announcing the rates for the Congregate Care Level 3 Supplemental Security Income (SSI) benefit for 2022. As LeadingAge NY previously reported, the federal cost of living adjustment (COLA) of 5.9 percent is applied only to the federal portion of the Congregate Care Level 3 SSI benefit, bringing it up to $841 per month. There is no COLA made to the state portion (SSP); it remains funded at $694 per month. Thus, the total benefit for residents who receive both SSI and SSP is $1,535 per month. This includes a personal needs allowance (PNA), which is also increased by 5.9 percent, to bring it to $222 per month. Those who receive Social Security or other unearned income not counted by Social Security are able to retain an additional $20. Adult care facilities (ACFs) will receive $1,313 for cost of care.

The DAL includes a notice for residents who receive SSI that describes the changes effective Jan. 1, 2022. The notice is to be conspicuously posted in an area or areas accessible to residents. The DAL also reminds ACFs of the regulatory requirements regarding notice to residents. In general terms, Assisted Living Residences (ALRs) must provide 45 days’ notice of an increase in fees, while other ACFs must provide 30 days’ notice.
