All ACFs Should Review New DALs from DOH

The Department of Health (DOH) issued two Dear Administrator Letters (DALs) last week for adult care facilities (ACFs). The first DAL announces changes to the list of equivalencies – that is, Department-approved equivalent methods for meeting the intent of certain regulations. There are substantial changes to the list, including the removal of some and the modification of others, so all members are encouraged to review carefully. The DAL directs facilities with current equivalencies for the items being removed to resubmit under the waiver process. The DOH-4235 Waiver Request/Equivalency Notification Form can be used to request a waiver or notify the Department when using an equivalency.

The second DAL provides guidance to ACFs regarding tiered fee arrangements. This issue has been under discussion for some time in the Department. We encourage members who have tiered fee arrangements or were considering using them to review this guidance carefully.
