LeadingAge NY Continues ALP Advocacy Regarding Federal HCBS Settings Rule

LeadingAge NY has been working for several months now with members to consider how the Medicaid Assisted Living Program (ALP) can fully comply with the federal Home and Community-Based Services (HCBS) Settings Rule. At issue is how to address the conflict-free case management requirement. Click here for more background on this issue.

The State has identified the carve-in of the ALP into managed care and Managed Long Term Care (MLTC) as a way to comply with the requirement. LeadingAge NY, together with the Empire State Association of Assisted Living (ESAAL), submitted this letter to the Department outlining our concerns about that approach. We are working to identify other strategies to comply with the conflict-free case management requirement and continue to welcome member input.
