DOH Issues Directive Regarding ACF Resident Economic Impact Payments

The Department of Health (DOH) has issued a directive regarding the Economic Impact Payments (EIPs) that residents of adult care facilities (ACFs) have or will receive. The letter reminds providers of their case management obligation and provides clarifications regarding how this income will be considered for the purposes of public benefit eligibility. The letter also notes that ACFs cannot use EIP funds to cover arrearages, absent a court-issued money judgment or the resident’s written authorization to use EIP funds to cover arrearages as to which the ACF previously provided written notification to the resident. Members should review the directive carefully.
