Judge Holds Hearing on Nursing Home Minimum Hours/Minimum Spending Lawsuit

A hearing on LeadingAge NY’s lawsuit challenging the nursing home minimum hours and minimum direct care spending laws was held on Jan. 3rd. Judge James Gilpatric granted our motion to amend and supplement the complaint, enabling us to update the complaint based on recent developments in the adoption of regulations and discussions at the Public Health and Health Planning Council meetings. He did not rule on our motion for a preliminary injunction. After the parties submit briefs on a new motion to dismiss that the Attorney General intends to file, Judge Gilpatric will hear oral argument on the motion for the preliminary injunction and the State’s motion to dismiss.
