LeadingAge NY Nursing Home State Compliance Tool Updated

Nursing homes are grappling with numerous new state requirements as a result of legislation enacted in 2021 and 2022. Much of this legislation was intended to provide greater transparency into the ownership and operation of for-profit nursing homes, but nevertheless also affects not-for-profit and public facilities. Several months ago, LeadingAge NY created a compliance tool for members to assist them in implementing policies and procedures to address these new requirements. We have updated the tool to reflect amendments enacted in 2022 and regulations proposed and adopted in response to the new laws.

The updated version of our state nursing home requirements tool, current as of March 11, 2022, is available here. While some of the new laws included in the document took effect last year, others have 2022 effective dates. The following laws take effect in March or April 2022:

  • Certificate of Need (CON) Character and Competence Standards
  • Anti-Microbial Stewardship Program
  • Infection Control Audits (proposed amendments would delay this until Dec. 1, 2022)
  • Long Term Care Ombudsman Posting Requirements

In addition, as indicated on the chart, new requirements to post star ratings took effect on Jan. 6th of this year. Minimum staffing hours and spending ratios laws were also scheduled to take effect in January, but have been delayed by executive order until March 31st. LeadingAge NY will notify members if and when that order is extended.

Please note that this compliance tool is an evolving document and covers only new state legislation and related regulations. It does not include federal requirements, nor does it include state requirements that pre-date 2021 or that are not derived from state legislation.
