DOH Clarifies Nursing Home CNA Recertification Requirements
(Oct. 28, 2025) The Department of Health (DOH) issued a Dear Administrator Letter (DAL) (DRS 25-07) to nursing homes today, Oct. 28th, clarifying the requirements surrounding recertification of certified nurse aides (CNAs). The guidance reiterates existing requirements under Title 10 NY Codes, Rules, and Regulations (NYCRR) § 415.26(d)(6) and notes that only Article 28-licensed facilities and staffing agencies or employment organizations that employ CNAs are authorized to recertify CNAs. Notably, adult care facilities (ACFs) (Article 7) and home care agencies (Article 36) are not authorized to issue recertifications, as they are not considered health care facilities under the regulation.
