In comments submitted to HUD, LeadingAge called on the agency to exempt federal programs that fund affordable housing developments from BABA compliance requirements.

The ruling only applies to HUD’s use of FY 2025 funds, but HUD has signaled that similar constraints will be applied for the FY 2026 funding provided by Congress. LeadingAge is pleased with the ruling and shares concerns about the stability of future funding.
