Update: Paying for Live-In 24 Hours of Care

On Nov. 26, the Department of Health (DOH) posted MLTC Policy 14:08, "Paying for Live-In 24 Hour Care for Personal Care Services and Consumer Directed Personal Assistance Services." The purpose of the policy is to clarify to home care providers and managed care plans, compliance with US Dept. of Labor (29 CFR 785.22) and NYS Dept. of Labor (Counsel Opinion Letter, N.Y. Dept. of Labor, RO-09-00169 "Live-In Companions").

According to the new policy, Managed Long Term Care (MLTC) plans and their network of providers are required to provide a rate of payment that is based upon 13 hours of care. This policy will be retroactive to April 1, 2014. DOH suggests questions on this policy should be directed to the MLTC plan manager.
