Member Input Sought on LHCSA Need Methodology

The Department of Health (DOH) is required by 2018-19 State Budget language to establish a public need methodology for Licensed Home Care Services Agencies (LHCSAs) in New York State.

LeadingAge NY urges any and all members – LHCSAs, Assisted Living Program (ALP)-affiliated LHCSAs, those overseeing the continuum of long term care services, or otherwise – to help us develop feedback for the Department’s Request for Information (RFI) on this matter. DOH wants to hear from all angles – administration, providers, and the public. We believe that member experience from other Certificate of Need (CON) processes will also be helpful.

Currently, LHCSAs must prove character, competency, and standing in the community for approval from the Public Health and Health Planning Council. However, they will now have to undergo review to demonstrate public need for their services, as well as their financial resources, financial revenues, and other relevant items. The need methodology will go into effect April 1, 2020, when the licensing moratorium on LHCSAs is lifted.

Please review the RFI to understand the range of issues being considered. The group’s tasks will likely require feedback preparation, at least two conference calls, and review of our draft comment. Comments on the RFI are due by Oct. 12th.
