Advocacy on LHCSA Moratorium Guidance

The Department of Health (DOH) recently issued guidance fleshing out their moratorium on granting licenses to Licensed Home Care Services Agencies (LHCSAs) pursuant to the recently enacted state budget. LeadingAge NY provided comments to DOH on the guidance advocating for flexibility relating to changes of ownership of LHCSAs, including allowing the approval of a new controlling entity above a currently operating LHCSA. The Legislature is attempting to address the finer details of the LHCSA moratorium in the final days of session.
