Another TBI Waiver Extension

On July 21st, the Department of Health (DOH) announced that the Traumatic Brain Injury (TBI) Medicaid waiver received another temporary extension for 40 days, through Sept. 1, 2017. This extension allows DOH to address additional questions raised by the Centers for Medicare and Medicaid Services (CMS) regarding the waiver renewal application.

DOH did state that CMS has approved the state’s Corrective Action Plan (CAP) for compliance with the federal conflict of interest (COI) requirements. As we previously reported, DOH needed to have an approved CAP in order for the pending TBI waiver application to be approved by CMS and needed to have in the waiver application language confirming the CAP approval. Now that the CAP is approved, DOH has begun to outline the steps necessary to meet COI compliance standards. CMS has indicated that full implementation with COI requirements must be accomplished by Jan. 1, 2019.

DOH is planning to conduct a statewide discussion on the latest information after the content of the waiver is approved. LeadingAge NY will keep members posted on any new information.
