OMIG Posts Final NHTD Audit Protocols

The New York State Office of the Medicaid Inspector General (OMIG) notified LeadingAge NY that they have posted the final Nursing Home Transition and Diversion (NHTD) Medicaid waiver audit protocols. You may recall that in November 2016 and May 2017, LeadingAge NY collaborated with other provider associations and commented on the proposed NHTD audit protocols.

We had provided general comments, such as including language about extenuating circumstances, as well as specific comments to OMIG. The specific comments revolved around protocols on the Missing Service Plan/Revised Service Plan; Failure to Meet Service Coordination Requirements; Service Coordination Caseload Exceeds Limit; Service Performed by Unqualified Structured Day Program Staff; and Annual HCSS in-service training.

The second version, in May 2017, incorporated some of our suggestions, but not all. This final version did not incorporate our additional suggestions on providing further clarity or flexibility, or incorporating a recent Dear Administrator Letter.

As a reminder, OMIG has included two new protocols:

  • Failed to Obtain Authorized Practitioner’s Signature within Required Time Frame; and
  • Missing Documentation of Required Criminal History Check.
