March 1st Deadline for Conflict of Interest Compliance for NHTD/TBI Waiver Services

The Department of Health (DOH) held a webinar on Tues., Jan. 9th regarding Conflict of Interest (COI) Compliance for the Nursing Home Transition & Diversion (NHTD) and Traumatic Brain Injury (TBI) waivers. Provider agencies and service coordinators for the waivers are required to comply with interim COI measures during the transition to managed long term care (MLTC) slated for Jan. 1, 2019. DOH has issued a COI Compliance Implementation Plan form and Provider Attestation to be completed per region by all provider agencies and service coordinators serving waiver participants. Forms must be submitted per region to each respective Regional Resource Development Agency by March 1, 2018. This will help DOH assess capacity for services, ensure COI policy implementation, and determine whether any rural or cultural exemptions will be permitted. DOH will also use the information to gauge current compliance and will assist agencies with additional compliance measures to ensure that necessary firewalls are in place to avoid influence by service coordinators on participant choice of providers and services.

The timeline for this process is strict and soon. Failure to submit a COI Compliance plan by the March 1st date will result in an agency being put on vendor hold for new participants.
