DOH Issues FAQ Regarding TBI Medicaid Waiver Application and Conflict of Interest

The Department of Health (DOH) has made available a Frequently Asked Questions document relating to its Oct. 17th webinar on the Traumatic Brain Injury (TBI) Medicaid Waiver Application approved in September 2017 and its January webinar regarding Nursing Home Transition and Diversion (NHTD)/TBI Conflict of Interest criteria. Among other things, the document clarifies new provisions relating to:

  • The Uniform Assessment System (UAS)-NY Community Assessment;
  • Participant scoring on Nursing Facility Level of Care (NFLOC) and eligibility protocols;
  • Service Coordination supervisors;
  • Qualifications of Independent Living Skills Training (ILST) and Community Integration Counseling (CIC) providers;
  • Some billing and rate questions regarding RN services;
  • Changes in Incident Reporting;
  • Service limits on Positive Behavioral Intervention and Supports (PBIS) and ILSTs for waiver recipients; and
  • Conflict of Interest requirements.

DOH states that it will be developing a revised Program Manual for TBI and will soon hold a webinar on cost reporting for waiver programs. As you know, Conflict of Interest implementation forms are due March 1st. Please let us know how the compliance process is unfolding for your organization, especially if you have difficulties with the information you present to the Regional Resource Development Centers (RRDCs) and DOH regarding firewalls and your existing corporate structure.
