State Issues Request for Information for EVV Vendor Solutions

The Department of Health (DOH) recently issued a Request for Information (RFI) for solutions from vendors as the State implements Electronic Visit Verification (EVV) pursuant to the 21st Century Cures Act. All states must require EVV use for all Medicaid-funded Personal Care Services (PCS) by Jan. 1, 2020 and all Home Health Care Services (HHCS) by Jan. 1, 2023.

The law defines an EVV solution as “a system under which visits conducted as part of PCS and HHCS are electronically verified with respect to: (i) the type of service performed; (ii) the individual receiving the service; (iii) the date of the service; (iv) the location of service delivery; (v) the individual providing the service; and (vi) the time the service begins and ends.”

DOH specifically released the RFI to:

  • Identify the options or different types of EVV solutions available in the market;
  • Distinguish what EVV solutions are available that accommodate the newly released Centers for Medicare and Medicaid Services (CMS) guidance;
  • Understand how the available EVV solutions can address the needs and concerns of New York’s diverse stakeholders; and
  • Identify challenges and timelines related to those different types of EVV solutions.

Common themes that emerged from the State’s stakeholder Listening Sessions regarding EVV solution capabilities are that EVV solutions should:

  • Be flexible in regard to where consumers receive services, how data is collected, and the technology options available to them;
  • Minimize implementation costs;
  • Address the unique needs of the consumer directed population; and
  • Ensure privacy and security with respect to data collection.

LeadingAge NY provided public comment on the requirement and is calling for flexibility for both providers and consumers. To review the range of comments provided by all stakeholders, see the Stakeholder Convening Report. For the EVV RFI, please click here. The deadline for submission of responses to the RFI is Nov. 7, 2019. The Department will be submitting a request for a one-year extension of the PCS deadline of Jan. 1, 2020.

LeadingAge NY will keep members updated on the implementation of this requirement.
