New York Asks CMS for EVV Implementation Extender

The Department of Health (DOH) has officially requested a one-year extension from the Centers for Medicare and Medicaid Services (CMS) for compliance with Electronic Visit Verification (EVV) for Medicaid-funded personal care services (PCS), as required by the 21st Century Cures Act. In the “exception” document, DOH says that it has not selected an EVV model but plans to select one that "best meets stakeholder needs and minimizes concerns expressed by stakeholders." DOH also intends to research modifying an existing vendor contract to include EVV in the current Medicaid Management Information System, procuring a new vendor through a request for proposals (RFP), or a single/sole source contract. The State plans to have its implementation model determined by January 2020.

Last week, CMS provided an informational bulletin regarding federal funding for states that utilize outcomes-based certification for EVV. States are eligible to receive enhanced, 90 percent Federal Financial Participation (FFP) to design, develop, and implement EVV systems, which then must be certified to continue to receive enhanced funding.
