DOH Issues HCBS DAL on Verification of Employment Requirement

On May 24th, the Department of Health (DOH) issued a Dear Administrator Letter (DAL) clarifying that Home and Community-Based Services (HCBS) providers are required to verify the employment history of personnel and ensure that personnel records include verifications of employment history. It is the Department’s understanding that some employers are contracting this task out to outside vendors and charging a fee for verifying employment history. Some employers asked to provide this information are refusing to do so. The DAL communicates that contracting out this task is not permitted, as it functions as a barrier to the efficient and effective creation of a stable, trained home care workforce. Employers who are referred to vendors for employment verification should report this practice immediately to homecare@health.ny.gov.
