DOH Issues Emergency Transitional Adult Home Regulations

The Department of Health (DOH) has announced the promulgation of new emergency regulations, which amend 18 NYCRR §§487.4, 487.5, and 487.10. These amendments prohibit Transitional Adult Home operators from admitting a prospective resident without first requesting that the Department conduct a screening to see if the individual may be a person with serious mental illness and, depending on the screening results, obtaining a mental health evaluation. The Oct. 23rd New York State Register posted an announcement of the promulgation of emergency regulations on pages 47 and 49. The State will accept comments on the regulations for up to 60 days after this publication. Members with comments on the regulations are encouraged to provide comments and to share with LeadingAge NY any suggestions.
