Comments on ACF Admission and Retention Regulations Accepted Until Nov. 13, 2018

Adult care facility (ACF) and assisted living members are reminded that the State has published regulatory changes for public comment, which are due by Nov. 13, 2018. These changes, which prohibit ACF operators from excluding residents or potential residents who primarily use a wheelchair for mobility, were initially published as emergency regulations on May 25, 2018. Click here for more background on the regulatory changes. The regulatory promulgation process requires the Department of Health (DOH) to republish the regulations for public comment, which will be accepted by mail or electronically until Nov. 13th.

Members are encouraged to provide us with any comments they would like us to include in our comment by Nov. 11th. You may also submit comments directly by email to regsqna@health.ny.gov or by mail to Katherine Ceroalo, DOH, Bureau of Program Counsel, Reg. Affairs Unit, Room 2438, ESP Tower Building, Albany, NY 12237, 518-473-7488.
