Resources to Understand New Federal Rule on HCBS Waiver Services

The Centers for Medicare and Medicaid Services (CMS) has made available a copy of the webinar presentation given to the public on Jan. 23rd on the final rule regarding Home and Community-Based Services (HCBS) provided through federal waivers.  As we reported, these new regulations create new standards and flexibility regarding HCBS waivers.  It also puts some parameters around settings in which such Medicaid covered services can be provided. Click here to access the CMS presentation materials.

LeadingAge NY counsel, Hinman Straub, conducted an analysis of the rule as it may impact the provision of Managed Long Term Care (MLTC) services provided in assisted living.  Members can access that analysis here.  While we are pleased that many problematic aspects of this proposed rule have been amended, we will work to obtain greater clarification and urge for flexibility in the implementation of these new requirements.
