DOH Issues DAL to ACFs that Serve Medicaid-Eligible People in Receipt of Medicaid-Funded HCBS

The Department of Health (DOH) issued a Dear Administrator Letter (DAL) alerting adult care facilities (ACFs) that have one or more residents who receive Medicaid-funded home and community-based services (HCBS), whether within or outside the facility, that they must meet the established standards expressed in the federal HCBS settings rule by March 17, 2022. DOH will begin conducting onsite assessments for ACFs and assisted living residences (ALRs) that house one or more residents in receipt of Medicaid-funded HCBS to help such facilities ensure compliance with the HCBS final rule. The DAL includes guidance regarding the rule and how to comply. Questions regarding this guidance should be directed to DOH’s Heidi Hayes at acfHCBS@health.ny.gov.
