DOH Asks All ACFs to Complete HCBS Rule Self-Assessment by Feb. 28th

Members may recall that the Department of Health (DOH) issued a Dear Administrator Letter (DAL) in November regarding the federal Home and Community Based Settings (HCBS) rule. The DAL reports that DOH must ensure that those adult care facilities (ACFs) having one or more residents who receive Medicaid-funded HCBS meet the established standards expressed in the HCBS Final Rule by March 17, 2022. DOH has issued a subsequent DAL announcing the availability of the HCBS 2019 Self-Assessment on the Health Commerce System (HCS). This self-assessment is designed to measure compliance with the rule. DOH asks that all ACFs, including assisted living programs (ALPs) who may have responded previously to similar self-assessments, respond to the self-assessment by Feb. 28, 2019. The DAL notes that while not all ACFs are subject to the specifications of the HCBS Final Rule, DOH is asking all facilities to complete the assessment. Questions regarding the self-assessment can be directed to DOH’s Heidi Hayes at acfHCBS@health.ny.gov.
