Advanced Home Health Aide Legislation: What It Means for You

LeadingAge NY’s counsel, Hinman Straub, has provided an analysis of legislation we anticipate will be signed by the Governor shortly, which will authorize advanced home health aides (AHHAs) to perform certain advanced tasks under the supervision of a registered professional nurse (RN) employed by a home care services agency (CHHAs and LHCSAs), hospice program, or an enhanced assisted living residence (EALR). LeadingAge NY has been working on this issue for several years and was pleased that legislators and the Governor were able to arrive at an agreement this year. The legislation will provide more flexibility for member organizations and provide opportunities for advancement for talented home health aides (HHAs).

While we anticipate that the Governor will sign the bill, it is important to note that the bill has yet to be signed and thus is not yet in effect. It will also take some time to implement several aspects of the legislation. We encourage home health, EALR, and hospice members to review the analysis, however, to anticipate how it will affect them in the future.
