DOH Provides ALPs With Guidance on Federal HCBS Rule

The Department of Health (DOH) has issued guidance on the federal Home and Community Based Settings (HCBS) Rule to help assisted living programs (ALPs) come into compliance. Questions regarding the rule can be directed to DOH’s Division of Adult Care Facility and Assisted Living Surveillance at ACFHCBS@health.ny.gov.

The federal rule applies to services provided under a Medicaid federal HCBS waiver and the settings in which they are provided. Members are reminded that the rule will apply to the ALP once the program and population are transitioned into managed care and managed long term care, as managed care is provided in New York under a waiver program. Further, states have until 2022 to comply with the federal rule. Thus, there is time for providers to transition into compliance.
