LeadingAge New York opposes this legislation which would require every high-rise property owner in the State to develop an emergency evacuation plan for residents with disabilities. The bill interferes with the ability of high-rise property owners and local law enforcement and fire safety personnel to continue to create and safely implement individualized evacuation plans for senior housing communities

Prevents the use of property guardianships under Article 81 of the Mental Hygiene Law by nursing homes and other providers to pursue payment from incapable residents for their services, when the residents or their representatives fail to pay for such services.

This bill would establish a demonstration program authorizing Certified Nursing Aides (CNAs) who receive advanced training to administer medications in nursing homes in St. Lawrence County under the supervision of a Registered Nurse (RN). LeadingAge NY supports this legislation.

LeadingAge NY vocalizes concerns on this bill, which would require payment of claims submitted under contract or agreement with Medicaid Managed Care and Managed Long Term Care (MLTC) plans for home and community based long term services and fiscal intermediaries to include reimbursement for expenses relating to the provision of Personal Protective Equipment for direct care workers and care recipients, and for an emergency inventory of a 90 day supply of PPE.

The first bill adds the Assisted Living Program (ALP) as an eligible provider type under the Vital Access Provider (VAP) program. The second bill makes both ALPs and hospice providers eligible to apply for funding under the Statewide Health Care Facility Transformation Program.

LeadingAge New York opposes this legislation which would place substantial limitations on a landlord’s ability to terminate the tenancy of seniors residing in certain housing facilities. 

LeadingAge NY has concerns about this bill, which requires assisted living facilities to notify residents of changes to medical and support services 180 days prior to such changes taking effect. 

LeadingAge New York opposes this legislation which specifies extensive procedures for the closure and/or decertification of assisted living residences. While the spirit of the bill is laudable, the Department of Health already requires a comprehensive written closure plan.
