LeadingAge NY and ADHCC Provide Comment to OMB on HCBS Settings Rule and Its Undue Burden on HCBS Medicaid Providers
(May 13, 2025) LeadingAge NY and the Adult Day Health Care Council submitted recommendations this week in response to a Request for Information issued by the federal Office of Management and Budget (OMB) seeking information on overly burdensome regulations.
Our comment letter provided an overview of the many ways the federal Home and Community-Based Services (HCBS) Settings Rule imposes undue financial, programmatic, and administrative burdens on Medicaid providers serving older adults with functional limitations and people with disabilities who reside in their homes and communities. We highlighted the problematic Heightened Scrutiny process and Conflict of Interest requirements; inappropriate policies relating to community integration; and the Rule's significant financial and operational costs relating to staffing, transportation, and administration.
LeadingAge national also provided comment to OMB on several regulations relating to long term providers.
