CMS Issues Update to State Operations Manual (SOM)

The Affordable Care Act (ACA) provides nursing homes with the opportunity for an Independent Informal Dispute Resolution (IIDR) process to dispute survey findings.  The update to the SOM outlines the timeframes and process for the IIDR.  The opportunity for an IIDR exists when a Civil Money Penalty (CMP) has been imposed. The IIDR must be requested by the facility within 10 days of receipt of CMS’s offer and must be completed within 60 days of the facility’s request.  Currently New York and New Jersey have a reciprocal arrangement where each state acts as the independent body reviewing IIDRs from on behalf of the other.  The number of these requests has been minimal.
