LeadingAge NY Urges NYS to Prioritize Older Adults in LIHTC Administration

(April 8, 2025) Following oral testimony presented at the NYS Homes and Community Renewal (HCR) public hearing on March 31st, LeadingAge NY submitted written comments on the Notice of Proposed Rulemaking for the Low-Income Housing Tax Credit (LIHTC) 4 percent and 9 percent Qualified Allocation Plans (QAPs), the State Low-Income Housing Tax Credit (SLIHC) regulation, and the housing needs of NY’s low-income older adults.

The Notice of Proposed Rulemaking to revise administration of the tax credit programs was published in the State Register on Jan. 29th, triggering a public comment period culminating in the March 31st hearing and an April 7th deadline for submission of written comments.

In its oral and written statements, LeadingAge NY highlighted the growing percentage of older adults comprising NY’s population and urged the State to take substantive, timely steps to leverage the process of revising administration of the LIHTC and SLIHC programs as part of a holistic approach to ensuring that the State is a safe, healthy, and affordable place to live and age for all New Yorkers.

Recognizing the agency’s efforts to streamline and clarify various scoring criteria and administrative processes, and to distinguish supportive housing projects from projects serving older adults requiring access to services to remain independent, the testimony made additional recommendations based on member feedback including establishing a set-aside for senior housing projects, exploring mechanisms within the tax credit programs to underwrite the cost of “Resident Assistant” services in affordable senior housing, and allowing an opportunity to cure certain deficiencies prior to full proposal submission to support more successful first-time applications.
