FLSA Survey and Webinar

LeadingAge NY has worked with the Department of Health (DOH), Mercer, and other stakeholders on the Fair Labor Standards Act (FLSA) survey and attestation forms. We asked DOH, and they agreed, to conduct a webinar so members can understand the logic behind the survey questions. The webinar is being held this Wed., Aug. 17th from 12:30 p.m. to 2 p.m. The link to register for and join the webinar can be found here. The slides can be accessed here. Questions should be sent in prior to the webinar; DOH will address the questions during the webinar and not through a Frequently Asked Questions (FAQ) document as originally intended.

As we have previously reported, the purpose of the survey is to obtain the actual costs to home care providers of complying with the recent FLSA ruling, including paying for overtime at time and a half of the worker’s regular wage, paying for travel between patients' homes, costs of live-in cases, and other issues. DOH has stated that the results of this survey will be instrumental in determining whether the FLSA funding add-ons need to be adjusted up or down.

Some important information on the FLSA survey:

The 36-question survey includes the time periods of CY 2014 and then October 2015-March 2016 on total hours for aides for all Medicaid programs, number of overtime hours, amount paid to aides, number of unduplicated Medicaid clients, information on Live-In cases, 17 questions on travel expenses, and other administrative costs.
