DOH DAL Regarding Admission Agreements and Termination Notices

(May 6, 2025) Last week, the Department of Health (DOH) issued a Dear Administrator Letter (DAL) to adult care facilities (ACFs) to clarify expectations regarding Admission or Residency Agreements and when a 30-Day Notice of Termination is required. We believe that this DAL finally clarifies that a DOH Notice of Termination is not required for resident-initiated discharges; however, we are seeking clarification from DOH given that the DAL references a Discharge Notice in addressing this issue, rather than the DOH Notice of Termination Form. There are other details in the guidance that have raised questions with us. We will provide members with clarification as we receive it; please send us any questions you have so that we may bring them to our discussions with DOH.
