ADHC Self Assessment Survey 5.16

Yesterday, the Department of Health (DOH) posted DAL NH 19-04 and a self-assessment survey for HCBS Settings Rule compliance which must be completed by all ADHC programs by June 30. DOH first mentioned this self-assessment tool in the DAL posted April 8. ADHCC reported on the DAL and FAQs in a memo to members here.

DOH realizes that many providers may not be fully compliant with the HCBS Settings Rule requirements and the self-assessment is intended to provide a snapshot of your current level of compliance. According to the DAL, results of the assessment will guide the Department in developing education, training programs and guidance documents to facilitate full compliance. Remember, compliance must be met by 2022. Please complete the survey honestly and to the best of your ability.

Please provide the appropriate documentation for each question, as indicated.

ADHCC received clarification from DOH on the following questions:

For question #7 Location of the ADHCP, a hospital is also an institution; therefore, if your program is located inside the hospital or on the campus of a hospital, please indicate this on the survey.

Question #18, At some point in time were registrants (or their representative if they have one) given options of HCBS service settings they could choose from, including the ADHCP? If you are unsure if registrants were given choice of settings by a managed care organization’s nurse case manager or OPWDD care manager, please ask the plan or case manager to find out. Use the space in the comment box below to explain your answer. ADHCC has communicated to DOH on a number of occasions that care plans are often developed prior to ADHC admission and the ADHC program has little knowledge if individuals were given choices of settings. Please do not send protected health information to DOH.

Remember, the purpose of this survey is to collect data on current levels of compliance with the understanding that most, if not all, programs will need to make several changes by 2022. Some areas of compliance can be met with an amended policy and procedure; other provisions of the final rule may require an amendment to our regulations.
