DSRIP Weekly Update-Sept. 2, 2014

DSRIP Data Dashboard

The Department of Health (DOH) has unveiled “dashboards,” which enables users a mechanism to “better understand Medicaid utilization” as it relates to the Delivery System Reform Incentive Payment (DSRIP) program.  These DSRIP dashboards are interactive and publically available to DSRIP participants as well as other interested parties.  Users can create customized views to learn more about utilization in their particular area.

DOH has developed a variety of resources to help utilize the tool; it is recommended that you start by viewing the webinar and tutorial.  The dashboards and user resources are available on the DOH DSRIP page on the Performance Data section, which can be accessed here.

Certificate of Public Advantage Regulations

DOH has posted proposed regulations establishing a process for entities to obtain a Certificate of Public Advantage (COPA) pursuant to Public Health Law Article 29-F.  Article 29-F sets forth the State’s policy of encouraging appropriate collaborative arrangements among health care providers who might otherwise be competitors, if the benefits of such arrangements outweigh any disadvantages likely to result from a reduction of competition.  The law requires DOH to establish a regulatory structure allowing it to engage in active state supervision as necessary to provide some degree of protection under state and federal antitrust laws. 

The regulations will be open for public comment for 30 days.  A Notice of Revised Rulemaking appears in the Aug. 27 State Register, and a copy of the full text of the regulatory proposal is available on the Department’s website.  LeadingAge NY is analyzing the regulations, which have implications not only to DSRIP Performing Provider Systems (PPSs), but also other collaborative arrangements.

DSRIP Project Plan applications to be submitted by PPSs will include the opportunity to apply for a COPA, and the DSRIP Independent Assessor will review those requests.  DOH will separately review COPA requests that are not related to DSRIP projects.  Questions and comments may be directed to DOH at REGSQNA@health.state.ny.us.  In addition, members are encouraged to share any questions or concerns with us as we evaluate the regulations and their potential impact on members.
