Opportunity to Discontinue OMIG Audits Ending

Nursing homes with current (i.e., unfinalized) OMIG Medicaid audits of rate periods prior to 2012, should verify whether the issues being audited are covered by the Universal Settlement. If so, the home should request that that these audits be discontinued by notifying DOH. Most Medicaid rate issues through 2011 are included in the settlement unless specifically identified as excluded. Excluded items are detailed in a memo that can be downloaded here

Failure to identify such audits could result in the continued processing or finalization of such audits and recoupment,, even if those audits would otherwise be eligible for discontinuance under the terms of the Settlement.

Homes should submit this information in the body of an email titled “Audit Discontinuation” to Richard J. Zahnleuter, director, Bureau of Litigation in the DOH Division of Legal Affairs at richard.zahnleuter@health.ny.gov.
