Universal Settlement Signing Days Begin This Week
All nursing homes in the State should have received a package of documents via email las week concerning the Universal Settlement (US) of nursing home rate appeals and litigation. Member facilities are reminded of the designated US signing days and locations. A location for the New York City signing days has also been announced.
As noted in the US mailing sent out to nursing homes last week, each facility is required to execute the US Agreement as well as the appropriate Release(s) and return these materials to the State (at a signing day) or to the law firm that is the designated US Trustee for your facility by no later than Dec. 12, 2015. In an effort to obtain these documents in an expedited manner, “signing days” are being held as follows:
Albany
This Thurs., Dec. 3rd from 8 a.m. to 5 p.m. at Empire State Plaza, Concourse Level, Meeting Room 5, Albany, NY 12242
Rochester
This Fri., Dec. 4th from 9 a.m. to 5 p.m. at Harter Secrest & Emery, 1600 Bausch & Lomb Place, Sixth Floor Conference Room, Rochester, NY 14604
New York City
Dec. 7th, 8th and 9th from 9 a.m. to 5 p.m. at the LaGuardia Marriott, 10205 Ditmars Boulevard, Suite 811, East Elmhurst, NY 11369
Facilities need not register in advance to execute their Agreement and Release at one of the dates/locations listed above. DOH and the U.S. Trustees (Hinman Straub PC and O’Connell and Aronowitz) will be represented at these signing days, and a notary public will be present as well.
These “signing days” are purely for facilities’ convenience – you do not need to be present at these locations in order to execute the Agreement and Release. Instead, you can forward your executed Agreement and Release(s) to the designated US Trustee for handling and processing, provided you do so by Dec. 12, 2015.
