Universal Settlement Documents Due by Dec. 12th

Current operators and former owners of nursing homes throughout the State have received summary information and legal documents to review and execute in connection with the Universal Settlement of Nursing Home Rate Appeals and Litigation (“US”).

In-person signing days for the US were held in Albany and Rochester last week, and are being held today, today and Wednesday from 9 a.m. to 5 p.m. at the LaGuardia Marriott, 10205 Ditmars Boulevard, Suite 811, East Elmhurst, NY 11369. Facility representatives and former owner distributees who do not attend a signing day have the option of printing out the documents, executing them, and mailing one original executed package to the facility’s assigned US Trustee by the submission deadline, which is Dec. 12, 2015.

A frequently asked questions (FAQ) document has been drafted by LeadingAge New York and the New York Health Facilities Association (NYSHFA), and reviewed by the US Trustees. The FAQ addresses questions that have been received from facilities, accounting firms and counsel and is available here.

A communication addressed to current operators and former owners that may be having disputes related to the US was also issued and is available here.
