Challenges to Universal Settlement Exclusion Determinations Due Sep. 11

The Department of Health (DOH) posted facility-specific Universal Settlement appeal exclusion request review sheets during the week of Aug.17.  The review sheets indicate whether DOH agrees that each appeal that a provider identified as appropriate for exclusion from the settlement is indeed excludable. Providers have until Friday, Sep. 11, 2015 to examine the DOH determinations and submit additional documentation supporting any appeal exclusion that DOH rejected.  Please note that although the Dear Administrator Letter (DAL) posted with the review sheets indicates that providers must submit any additional documentation by the end of August, DOH extended that date to Sep. 11. 

Members with questions regarding the peculiarities of the DOH review lists have received responsive assistance by contacting Matt Leonardo (Matthew.Leonardo@health.ny.gov).          

Although the DAL indicates that litigation exclusion and OMIG audit discontinuation request reviews will be forthcoming, some of the listings currently posted include litigation.  

We urge all members to access their exclusion request lists promptly, to submit documentation if needed and to contact Matt Leonardo or us with questions. If your facility submitted a list but no longer has access to the HCS, please contact Mr. Leonardo to obtain your exclusion review list.
