DOH Is Accepting Comments on Statewide Transition Plan for Compliance with Federal HCBS Settings Rule

The Department of Health (DOH) has posted a draft of the proposed Home and Community-Based Services (HCBS) Final Rule Statewide Transition Plan (STP). Members should note that there are specific sections of the plan related to:

  • adult care facility and assisted living services
  • adult day health care (ADHC)
  • managed long term care
  • Medicaid managed care
  • social adult day care
  • Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) waivers
  • Children’s HCBS waivers
  • Community First Choice Option
  • Office for People with Developmental Disabilities (OPWDD) HCBS
  • Office of Mental Health (OMH) services
  • Office of Addiction Services and Supports (OASAS)
  • AIDS Institute-operated ADHC and supportive housing

Comments on the STP will be accepted until Jan. 6, 2023 by email to hcbsrule@health.ny.gov or by mail to E. Palmiero, DOH OALTC, One Commerce Plaza, Suite 1624, Albany, NY 12260. LeadingAge NY will be providing comment on behalf of our members. Please provide any comments to be incorporated as soon as possible, but no later than Jan. 5, 2023, to Diane Darbyshire at ddarbyshire@leadingageny.org.
