Home Care Worker Wage Parity 2016 Forms Posted

Last week the Department of Health (DOH) posted an alert to remind home care and managed care providers of the ongoing compliance in New York City and the third year implementation of the Home Care Worker Wage Parity Law in Nassau, Suffolk and Westchester counties that begins on March 1, 2016.

The forms are now posted. The forms certifying compliance with the law must be submitted via email to HCWorkerParity@health.ny.gov by March 1, 2016.

The forms for Certified Home Health Agencies (CHHAs), Long Term Home Health Care Programs (LTHHCPs) and Managed Care Organizations (MCO) must be completed and emailed to DOH at HCWorkerParity@health.ny.gov.

The other form for Licensed Home Care Services Agencies (LHCSAs) is sent to the CHHA, LTHHCP or MCO with which the LHCSA contracts, not DOH. The LHCSA form, also due March 1, 2016, covers the period March 1, 2016, through May 31, 2016. It is the responsibility of the CHHAs, LTHHCPs and/or MCOs that contract with LHCSAs to ensure they have obtained the written certification on a quarterly basis from the LHCSA or other entity which attests to the LHCSA's (or other entity's) compliance with the state's Home Care Worker Wage Parity Law for defined certification periods and on a prospective basis.

As a reminder this applies to agencies and plans in New York City, Westchester, Nassau, and Suffolk counties. The forms are always prospective and now applies to the time period March 1, 2016, to Feb. 28, 2017 period.
