Another Draft Fair Labor Standards Act (FLSA) Survey
The Department of Health (DOH) sent LeadingAge New York another version of a draft survey for comment. This survey is to arrive at a truer cost of home care providers complying with the Fair Labor Standards Act (FLSA). This survey is being developed by DOH, several home care associations and Mercer, the state’s actuary. Initially, the survey was mainly focused on the overtime and live-in cases. The latest version has a more robust section on travel costs.
LeadingAge NY has again shared this latest version with several home care members. Our concerns and suggestions will be provided to DOH at an upcoming April 5th meeting. Once the survey is final, DOH will post it to the Health Commerce System for all home care providers to complete. After the findings are compiled, DOH will be able to revise the rates, if needed, for 2016.
