DOH Confirms Extended Conflict of Interest Deadline for NHTD/TBI Waiver

The Department of Health (DOH) has received approval from the Centers for Medicare and Medicaid Services (CMS) to extend the compliance date for conflict of interest (COI) implementation for the Nursing Home Transition and Diversion (NHTD) and Traumatic Brain Injury (TBI) Waivers from Nov. 11, 2023 to March 1, 2024. Service plans with an effective date prior to March 1, 2024 that providers have held because of COI non-compliance can now be approved.

Currently, LeadingAge NY does not have a clarifying link regarding the new date, but will be sure to provide more information as it becomes available. More information on COI is available here, and other NHTD/TBI Waiver updates are here and here.
