Social Adult Day Care and MLTC: Implementation of New Social Adult Day Care Certification Process

The new policy, MLTC 15:01 - Social Adult Day Care and Managed Long Term Care: Implementation of New Social Adult Day Care Certification Process, can be found under MRT #90. In this new policy, the Department of Health (DOH), with the Office of the Medicaid Inspector General (OMIG) and the New York State Office for the Aging (NYSOFA), establishes a new Certification process for Social Adult Day Care (SADC) entities that want to contract with Managed Long Term Care (MLTC) plans.

Effective immediately, certification will now be mandatory for all SADC entities that:

  • are currently contracting with a MLTC plan; or
  • want to enter into a contract with a MLTC plan.

Those SADC entities with existing contracts with a MLTC plan will have 30 days to complete the Certification. A Certification must be completed for each SADC site.

Completion of the Certification will attest to an SADCs compliance with Title 9 NYCRR section 6654.20, as required under Article VII, section C of the Managed Long Term Care model contract.

The MLTC plans will have several responsibilities:

  • ensure the SADCs under contract complete the certification;
  • plans cannot enter into a contract with a SADCs until a certification form has been successfully completed;
  • plans must request a copy of the confirmation notice generated as a result of a successful completion of the electronic certification form;
  • plans must retain the confirmation notice in their records;
  • DOH again clarifies previous policies on SADCs and Community Based Long Term Care Services. The policies include MLTC 13.05, MLTC 13:11 and a letter to MLTC plans;
  • DOH clarifies the process for terminating a contract between a SADC and a MLTC plan.
The SADC will have to:
  • provide the SADC owner and program director’s information, including Social Security Number;
  • answer 12 questions attesting to compliance;
  • list the MLTC plans the SADC has contracts with; and
  • certify that the information provided is true.

The certification can be found on the OMIG website under Compliance. This will be an annual certification process.
